State=PLEASE READ THE FOLLOWING LICENSE AGREEMENT CAREFULLY.\r\n\r\nONCE INSTALLED, THE ôVMN Toolbar(tm)ö SOFTWARE PLUGIN (the ôToolbarö) \r\nWILL AUTOMATICALLY LAUNCH EVERY TIME YOU EXECUTE THE \r\nMICROSOFT INTERNET EXPLORER BROWSER PROGRAM. BEFORE YOU CAN \r\nUSE THE TOOLBAR HOWEVER, YOU MUST ACCEPT THE FOLLOWING \r\nAGREEMENT (the ôAgreementö).\r\n\r\n\r\nIf you agree to the following Agreement between you (the user) and Visicom Media Inc. (ôVISICOMö), you will be granted the following limited rights to install and use the Toolbar:\r\n\r\nA. You may use the Toolbar for personal use, on a single computer per legitimate copy which you download from VISICOM. If you wish to use the Toolbar for commercial use or if you wish to redistribute the Toolbar to others, you will require the prior express written authorization of VISICOM or, alternatively, may do so after using VISICOMÆs ôVMN Toolbar Wizard(tm)ö customization service (after duly registering with VISICOM) and accepting the conditions applicable to that service;\r\n\r\nB. You may not otherwise reproduce, distribute, transmit, print or transfer information related to Toolbar. \r\n\r\nVISICOM PRIVACY NOTICE:\r\n\r\nBY PROCEEDING TO INSTALL THE TOOLBAR, YOU ACKNOWLEDGE AND \r\nACCEPT THAT, UPON ITS INSTALLATION, THE TOOLBAR WILL MODIFY THE \r\nSETTINGS OF YOUR BROWSER CONCERNING ôDNS ERRORö AND ôERROR 404ö \r\nPAGES. FURTHERMORE, ONCE INSTALLED, THE TOOLBAR MAY \r\nCOMMUNICATE CERTAIN BASIC USAGE INFORMATION TO VISICOM TO HELP \r\nVISICOM COMPILE GLOBAL STATISTICS CONCERNING USAGE OF THE \r\nTOOLBAR BY USERS (for example concerning the number of installations and unique \r\nusers, the number of clicks which the Toolbar receives, the number of searches performed by users, etc.). Such statistical information will not include any personally identifiable \r\ninformation regarding users.\r\n\r\n\r\nEVEN IF YOU ACCEPT THIS AGREEMENT, IT IS STRICTLY PROHIBITED TO:\r\n\r\nA. Modify the Toolbar in part or in its entirety;\r\n\r\nB. Decompile or reverse engineer the Toolbar.\r\n\r\nSHOULD YOU FAIL TO COMPLY WITH ANY OF THE ABOVE, YOUR RIGHT TO \r\nUSE THE TOOLBAR WILL BE AUTOMATICALLY TERMINATED. THIS \r\nTERMINATION WILL BE IN ADDITION TO ANY CRIMINAL, CIVIL OR OTHER \r\nREMEDIES WHICH VISICOM MAY SEEK. THE USER MAY CANCEL HIS LICENSE \r\nTO USE THE TOOLBAR BY UNINSTALLING AND DESTROYING OR ERASING \r\nALL COPIES OF THE TOOLBAR UNDER HIS CONTROL.\r\n\r\n\r\nEXCLUSION OF WARRANTY:\r\n\r\nTHE TOOLBAR IS PROVIDED UNDER LICENSE ON AN "AS IS" BASIS, WITHOUT \r\nWARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING WITHOUT \r\nLIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS \r\nFOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE RESULTS AND \r\nPERFORMANCE OF THE TOOLBAR IS BORNE BY THE USER. VISICOM MAY, AT \r\nANY TIME, TERMINATE THIS AGREEMENT BY NOTIFYING THE USER OF THE \r\nTOOLBAR.\r\n\r\n\r\nLIMITATION OF LIABILITY: \r\n\r\nIN NO EVENT SHALL VISICOM, OR ANY THIRD PARTY INVOLVED IN THE \r\nCREATION, PRODUCTION, OR DELIVERY OF THE TOOLBAR BE LIABLE UNDER \r\nANY CIRCUMSTANCES FOR ANY DIRECT OR INDIRECT DAMAGES \r\nINCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF BUSINESS \r\nPROFITS, BUSINESS INTERRUPTION, LOSS OF DATA OR OTHER PECUNIARY \r\nLOSS INCURRED BY THE USER AND ARISING OUT OF THE USE OR INABILITY \r\nTO USE THE TOOLBAR, EVEN IF VISICOM HAS BEEN ADVISED OF THE \r\nPOSSIBILITY OF SUCH DAMAGES. VISICOM SHALL HAVE NO LIABILITY \r\nWHATSOEVER CONCERNING ALEXAÆS USE OF ANY INFORMATION \r\nCONCERNING USERS OF THE TOOLBAR, PROVIDED THAT THE LIMITS SET \r\nFORTH HEREUNDER HAVE BEEN RESPECTED BY VISICOM.\r\n\r\n\r\nPROPERTY:\r\n\r\n"VMN Toolbar" and ôVMN Toolbar Wizardö are trademarks of VISICOM and are protected by the Canadian and international laws on trademarks and intellectual property. Use of the products' names is strictly forbidden unless it's used with the express written permission of VISICOM.\r\n\r\nThis Toolbar, including its code, documentation, appearance, structure, and organization is an exclusive product of VISICOM, which retains all intellectual property rights concerning the Toolbar, its copies, modifications, or merged parts, including any copyrights and invention rights.\r\n\r\n\r\nGOVERNING LAW AND FORUM:\r\n\r\nThis Agreement will be governed and interpreted according to the laws applicable within the province of Quebec, Canada. Any judicial proceedings relating to this Agreement must be presented in the Judicial District of Montreal, Quebec, Canada, to the exclusion of any other courts or jurisdiction.\r\n\r\n\r\n\r\nALEXA PRIVACY NOTICE AND AGREEMENT:\r\n\r\nTHIS TOOLBAR INTEGRATES CERTAIN SERVICES FROM ALEXA INTERNET, \r\nINC. ("ALEXA"). THE TOOLBAR MAY EXCHANGE DATA WITH ALEXA IN ORDER \r\nTO PROVIDE: (A) INFORMATION TO YOU ABOUT THE WEB PAGES YOU VIEW \r\n(ranking information, for example) AND (B) BASIC INFORMATION TO ALEXA ON \r\nYOUR USE OF THE TOOLBAR, INCLUDING THE IP ADDRESS OF YOUR \r\nCOMPUTER, THE URL OF THE WEB PAGES YOU VISIT AND, BECAUSE THE \r\nTOOLBAR COMMUNICATES VIA HTTP, DATA TYPICAL OF NORMAL HTTP \r\nCOMMUNICATIONS, SUCH AS USER AGENT AND OPERATING SYSTEM, WILL BE \r\nCOMMUNICATED.\r\n\r\nYou may disable the portion of the Toolbar that allows exchange of data with ALEXA, by accessing the ôOptionsö Page (in the Toolbar menus) and removing the ôAlexaö button from the interface of the Toolbar. If you do so, however, you will no longer have access to the information (like ranking) available from ALEXA about the Web pages you view, whether or not the Toolbar is installed. \r\n\r\nALEXA does not and will not attempt to analyze Web usage data it obtain through the \r\nToolbar to determine the identity of any particular Toolbar user. However, ALEXA may aggregate and analyze the information it collects through your usage of the Toolbar to \r\nimprove its service and to prepare reports about aggregate Web usage.\r\n\r\nALEXA knows that you care how information about you is used and shared. ALEXA \r\nappreciates your trust and undertakes to deal with your personal information carefully and sensibly. Information transmitted to ALEXA through your usage of the Toolbar is subject to ALEXAÆs Privacy Policy.
